This page explains how copyright owners may report allegedly infringing material published on Vesti.la and how affected content providers may respond when material is removed or restricted by mistake.

Before filing a claim

Use this process for copyright infringement concerns

Vesti.la respects the rights of writers, photographers, designers, publishers and other creators. We review properly submitted notices alleging that copyrighted material has been used without authorization.

This procedure is intended for copyright ownership and infringement claims. It is not the correct process for factual corrections, routine business updates, privacy concerns, trademark disputes or disagreement with an editorial opinion.

Before submitting a notice, consider whether the disputed use may have been authorized, licensed or permitted under applicable law. Copyright complaints should be specific, accurate and submitted in good faith.

Appropriate claims

When this procedure may apply

Your original photograph appears on Vesti.la without authorization.

A substantial portion of your protected written work has been reproduced.

Your illustration, graphic or other original visual asset has been copied.

Material supplied by another person appears to infringe rights you own or represent.

Different concerns

When another process is more appropriate

A restaurant address, menu item or business detail is outdated.

You disagree with a comparison, opinion or editorial conclusion.

You want to update a listing without claiming copyright ownership.

Your concern primarily involves privacy, trademarks, reputation or another legal issue.

Good-faith reporting

Submit notices responsibly

The person submitting a notice is responsible for the accuracy of the information provided and for having authority to act for the copyright owner.

This procedure must not be used to suppress lawful criticism, reporting, commentary or competition. False or materially misleading claims may carry legal consequences.

Work and location

Identify what is protected and where it appears

Identify the copyrighted work you believe has been infringed.

If several works are involved, provide a representative list.

Include the complete Vesti.la URL where the disputed material appears.

Describe the exact photograph, paragraph, graphic or other element at issue.

Claimant details

Identify yourself and your authority

Provide your full name and reliable contact information.

Explain whether you are the owner or an authorized representative.

Include a physical or electronic signature.

Provide supporting evidence of your authority when acting for another rights holder.

Required statement

Confirm your good-faith belief

State that you have a good-faith belief that the disputed use is not authorized by the copyright owner, the owner’s representative or applicable law.

The statement should relate specifically to the material identified in the notice rather than making a general claim about the entire website.

Accuracy statement

Confirm accuracy under penalty of perjury

State, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorized to act on the owner’s behalf.

A notice missing this statement may require clarification before it can be evaluated.

Helpful supporting material

Evidence that may assist the review

Supporting evidence does not replace the required elements of a notice, but it may help establish ownership, publication history or authority.

The original publication URL or publication date.

A source file or another record showing earlier publication.

Relevant copyright registration information, when available.

An explanation of your authority to represent another rights holder.

Any license, permission, revocation or agreement relevant to the disputed use.

Clear notice

Organize the communication carefully

Identify the message as a copyright infringement notice.

Place the exact Vesti.la URL in the body of the message.

Explain precisely which material is disputed.

Use screenshots only as supporting evidence, not as a substitute for the URL.

Information safety

Do not send unrelated sensitive records

Do not send passwords, payment information, complete government identification documents or unrelated confidential records.

Provide only the information reasonably necessary to identify the claimant, protected work, disputed material and authority to submit the notice.

Review procedure

What may happen after a notice is received

We may first determine whether the notice contains enough information to identify the claimant, protected work and disputed material.

We may request clarification about ownership, authorization, publication history or the exact location of the material. Relevant licenses, image submissions, contributor communications and source records may also be reviewed.

Access to disputed material may be restricted temporarily while the claim is assessed. A temporary restriction does not by itself constitute an admission of infringement or liability.

Possible action

Removal, replacement or continued publication

Depending on the information available, Vesti.la may remove the material, replace it, maintain a restriction or determine that no change is warranted.

Where appropriate, the person who supplied or published the material may be notified about the claim.

No automatic conclusion

A notice does not determine liability

Removing or restricting material does not necessarily mean that Vesti.la, a contributor or another party admits infringement, wrongdoing or legal liability.

A complaint also does not automatically require removal when it is incomplete, unsupported or submitted by someone without apparent authority.

Counter-notification

Responding when material was removed by mistake

A person whose material has been removed or restricted may submit a counter-notification when they believe the action resulted from a mistake or misidentification.

A counter-notification is a formal communication. It should not be sent merely because the person disagrees with the original claimant or wants the material restored immediately.

Identify the affected content

Describe the material that was removed or restricted.

Identify where it appeared before access was limited.

Provide your full legal name and reliable contact information.

Include your mailing address, telephone number and email address.

Required declarations

Explain the mistake and sign the response

State under penalty of perjury that removal resulted from mistake or misidentification.

Include any required consent-to-jurisdiction statement.

Include any required acceptance-of-service statement.

Add your physical or electronic signature.

Disclosure and restoration

What may happen after a counter-notification

A valid counter-notification may be shared with the person who submitted the original notice or that person’s authorized representative. This may include the identity and contact information required in the response.

The disputed material may remain unavailable during the applicable review period. It may later be restored when appropriate, or remain restricted when required by law, a court order or another valid legal basis.

Restoration is not automatic and no particular outcome is guaranteed.

Abuse prevention

Do not misuse the reporting procedure

Appearing in a photograph does not automatically make someone its copyright owner.

Owning a business does not establish ownership of every photograph or article about it.

Copyright notices should not be used to remove criticism or unwanted editorial coverage.

No person should claim to represent a rights holder without genuine authorization.

Repeated infringement

Action against repeated violations

Where appropriate, Vesti.la may restrict submission privileges, contributor access or other relationships involving persons who repeatedly provide infringing material.

Decisions may consider prior notices, counter-notifications, retractions, licensing evidence, court decisions and the circumstances of each case.
